An German couple is charged in Palma: In August 2024 they allegedly had sex in a hotel pool in front of guests — including children. The public prosecutor is seeking fines.
Allegation: Sex in the pool, spectators on the balconies
What began on a sultry summer night in Port d’Andratx ends up in court: A German couple will soon face trial in Palma for indecent behavior in public. According to the indictment, the two allegedly exposed themselves passionately at around 7 p.m. on August 13, 2024, in the pool of a hotel — in front of other guests at the water’s edge and on the balconies, as well as in front of several children.
According to investigators, the situation was so overt that some guests observed the incident and urged the couple to stop. Witness statements describe that the woman was naked, the man had partially removed his swim trunks, and the two ultimately engaged in sexual intercourse with penetration. Despite protests, the couple continued.
Indictment and potential punishment
The prosecutor's office accuses indecent display in front of minors as well as obscene exhibitionism. For each person, monetary penalties of 5,400 euros are demanded. The defendants are aged 43 and 42 according to investigators.
The arrest reportedly took place the day after the complaint by the hotel. Now a court date in Palma is set, where the charges will be examined. Such cases are usually not only criminally relevant but also raise questions about the responsibility of hosts, supervision duties, and the protection of minors.
What locals and guests say
Locals and guests still talk about the scene: Some say that in beach towns like Port d’Andratx one has seen a lot, others are outraged because children were present. A guest who wished to remain anonymous described the mood that evening as strangely disturbing — and reminded that many families come on vacation here and rely on consideration.
Legally, the court will weigh the evidence: witness statements, hotel reports, and possible video recordings may play a role. Regardless of the outcome, the case remains a talking point in the small port town — and a reminder that private freedom ends where others are harassed or endangered.
The trial date in Palma has been announced; until then the defendants are presumed innocent, as is customary in our legal system. For the tourist season, the case means hotels will monitor behavior in public areas more closely and refer to house rules if necessary.
